These Terms of Use & Sale (“Terms”) govern your access to and use of www.weartheclouds.com (the “Site”) and the purchase of products from us.
The Site is operated by OM GROUP INTERNATIONAL FZCO, trading as weartheclouds (“weartheclouds”, “we”, “us” or “our”).
Please read these Terms carefully before using the Site or placing an order.
By accessing or using the Site, creating an account or placing an order with us, you acknowledge that you have read and agree to these Terms together with any policies referred to in them.
If you do not agree with these Terms, you should not use the Site.
Nothing in these Terms is intended to exclude, restrict or override any consumer right that cannot lawfully be excluded under applicable law.

By placing an order, you confirm that the information you provide is accurate and that you are legally permitted to enter into the transaction.

6. PRODUCT AVAILABILITY
All products are subject to availability.
Adding an item to your shopping cart does not reserve that item.
An item may become unavailable before checkout is completed.
If we are unable to fulfil an order after payment has been taken, we will contact you and arrange an appropriate refund for the unavailable item.
We may limit quantities available for purchase where reasonably necessary, including to prevent fraud, abuse, unauthorised resale or misuse of promotions.
7. PLACING AN ORDER
When you place an order through the Site, you are requesting to purchase the products shown in your order.
You are responsible for checking your order before submitting it, including:

- Colours
- Quantities
- Delivery information
- Contact information
- Pricing
- Applicable delivery charges
You should ensure that all information submitted during checkout is accurate.
After placing an order, you may receive an electronic order confirmation.
An automated acknowledgement confirms that we received your order. It does not prevent us from carrying out reasonable fraud, payment, inventory or order verification before fulfilment.
8. ORDER ACCEPTANCE
We reserve the right to decline or cancel an order before fulfilment where reasonably necessary, including where:
- A product is unavailable
- Payment cannot be authorised
- Fraud or unauthorised payment is reasonably suspected
- Incorrect information has been provided
- There is an obvious pricing or technical error
- The order violates purchase limits
- We reasonably suspect unauthorised commercial resale
- The order would violate applicable law
- Delivery to the supplied location is not possible
If we cancel an order after receiving payment and you have not received the relevant goods, we will refund the applicable amount paid to the appropriate payment method, subject to applicable law.
We will not retain payment for products that we cancel and do not supply.
9. PRICES
Prices displayed on the Site are shown in the currency indicated at checkout.
For UAE purchases, prices will generally be displayed in United Arab Emirates Dirhams (AED) unless otherwise stated.
Applicable taxes will be handled in accordance with UAE law and displayed or included as required.
Delivery charges, where applicable, will be shown during checkout before you complete your purchase.
We may change product prices at any time, but a price change will not ordinarily affect an order already accepted by us.
10. PRICING AND TECHNICAL ERRORS
We make reasonable efforts to ensure prices and product information are accurate.
Occasionally, genuine typographical, technical or system errors may occur.
Where an obvious pricing or product-information error occurs before fulfilment, we may contact you to explain the error and, where appropriate:
- Allow you to proceed at the correct price; or
- Cancel the affected item or order and issue the appropriate refund.
We will not substitute another price or charge an additional amount without informing you.
Nothing in this section permits misleading pricing or limits rights available to consumers under applicable law.

Available payment methods will be displayed during checkout.
Payments may be processed by third-party payment service providers.
By submitting payment details, you represent that you are authorised to use the selected payment method.
We may carry out or rely upon reasonable payment, identity, security and fraud-prevention checks before fulfilling an order.
Payment information is also handled in accordance with our Privacy Policy and the applicable payment provider's terms and privacy practices.

14. RISK OF LOSS OR DAMAGE DURING DELIVERY
We do not require customers simply to deal with the courier themselves where an order arrives damaged, incorrect or incomplete.

Please retain the item and its packaging and, where reasonably possible, provide photographs or other information that helps us investigate the issue.
We will work with the courier or other service provider where necessary.
Your statutory rights against weartheclouds are not removed merely because a third-party courier was used to deliver the order.
15. RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges, refunds and store credit are governed by our Return & Exchange Policy, which forms part of these Terms.
Under our standard policy, eligible non-defective returns and exchanges may be subject to an AED30 return/exchange logistics fee.
The AED30 fee does not apply where weartheclouds confirms that the product:
- Has a manufacturing defect
- Arrived damaged
- Is incorrect
- Is incomplete
- Is materially different from the product ordered or advertised
Customers may have additional mandatory rights under applicable consumer protection law.
Nothing in these Terms or our Return & Exchange Policy limits any remedy that must legally be provided to a consumer.
16. DEFECTIVE PRODUCTS
If you believe an item has a manufacturing defect, please contact:

Depending on the circumstances and applicable law, an appropriate remedy may include:
- Repair, where appropriate
- Replacement
- Exchange
- Refund
- Another remedy required by applicable law
weartheclouds will not charge the customer the standard AED30 return/exchange fee for an approved manufacturing defect.
Normal wear and tear, accidental damage, misuse, improper care, unauthorised alteration or damage occurring after delivery through the customer's actions is not ordinarily considered a manufacturing defect.
17. CANCELLATIONS
If you wish to cancel an order, contact us as soon as possible at:
We cannot guarantee cancellation once an order has entered fulfilment or has been dispatched.
Where cancellation before fulfilment is possible, we will process the appropriate cancellation and refund.
After delivery, requests will be handled under our Return & Exchange Policy and applicable law.
18. STORE CREDIT
Where store credit is offered and accepted as a return resolution, it may be used towards eligible future purchases from weartheclouds.
Store credit:
- Has no cash value except where otherwise required by law
- May not ordinarily be transferred or resold
- Must be used in accordance with any conditions clearly disclosed when it is issued
Choosing store credit is optional where the customer is legally entitled to another form of refund or remedy.
weartheclouds will not use store credit to replace a mandatory consumer refund right without the customer's agreement where such agreement is legally permitted.
19. PROMOTIONS AND DISCOUNT CODES
From time to time we may offer:
- Promotional codes
- Sales
- Discounts
- Special offers
- Giveaways
- Bundles
- Other promotions
Additional terms may apply to a particular promotion.
Unless stated otherwise:
- Promotions cannot be exchanged for cash
- Discount codes may not be combined
- Promotions may be limited by date, product, customer or quantity
- Discounts apply only during the stated promotional period
- We may reject fraudulent or abusive use of promotional offers
If part of a promotional order is returned, any refund or store credit may be adjusted to reflect the actual amount paid and any promotional conditions that no longer apply, subject to applicable law.
20. BULK AND COMMERCIAL ORDERS
Standard products on the Site are primarily offered for consumer purchase.

Bulk or commercial purchases may be subject to separate pricing, payment, delivery and contractual terms.
We may reasonably limit or decline orders that appear to be intended for unauthorised commercial resale.
21. INTERNATIONAL ORDERS
The countries and locations to which we currently deliver will be determined by the shipping options available through the Site and checkout.
Where international delivery is offered, the customer may be responsible for import duties, customs charges, taxes or similar charges imposed by the destination country unless we expressly state otherwise.
Such charges may be collected by government authorities, customs agencies, couriers or other third parties and may be outside our control.
Where possible, any charges collected directly by us will be shown during checkout.
22. INTELLECTUAL PROPERTY
Unless otherwise stated, the Site and its content are owned by or licensed to OM GROUP INTERNATIONAL FZCO / weartheclouds and are protected by applicable intellectual property laws.

- Marketing materials
- Layouts
- Software and Site content
All rights are reserved.
You may view Site content for personal, non-commercial purposes.
Without our written permission, you may not:
- Reproduce our content for commercial purposes
- Modify and commercially distribute our materials
- Use our photographs to sell or promote third-party products
- Copy or imitate our designs
- Remove proprietary notices
- Create unauthorised derivative commercial works

Nothing in these Terms transfers ownership of our intellectual property to you.

- Feedback
- Photographs

- Social content
- Other submissions
You do not automatically transfer ownership of your original content to us merely by submitting it.
However, where you intentionally submit content for publication, promotion or use by weartheclouds, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish that content for reasonable business, marketing and promotional purposes, subject to applicable law and any specific agreement with you.
You confirm that you have the necessary rights to submit the content.
You must not submit content that:
- Infringes another person's intellectual property
- Violates another person's privacy
- Is fraudulent or misleading
- Is unlawful
- Contains malicious software
- Impersonates another person
- Is abusive, threatening or defamatory
We may moderate, remove or decline to publish submissions where reasonably appropriate.
24. PRIVACY
Your privacy is important to us.
Our collection, use, sharing, storage and protection of personal information are explained separately in the weartheclouds Privacy Policy.
The Privacy Policy should be read together with these Terms.
These Terms do not provide blanket consent to receive marketing communications.
25. THIRD-PARTY SERVICES AND LINKS
The Site may contain links to or integrations with third-party services, including:
- Payment providers
- Social media platforms
- Delivery providers
- Technology providers
- Other external websites
A link or integration does not necessarily mean that we endorse all content or practices of the relevant third party.
Third-party websites and services may operate under their own terms and privacy policies.
We are not responsible for independent third-party websites that we do not own or control, except to the extent responsibility cannot legally be excluded.
26. WEBSITE AVAILABILITY
We aim to keep the Site secure and available but cannot guarantee uninterrupted or error-free operation.

However, nothing in these Terms excludes or restricts warranties, remedies, product obligations or consumer rights that cannot legally be excluded or restricted.
Any rights relating to defective, damaged, unsafe, incorrect or misdescribed products remain subject to applicable law.
29. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, OM GROUP INTERNATIONAL FZCO / weartheclouds will not be responsible for indirect or consequential losses that were not reasonably foreseeable as a result of our breach.
However, nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
In particular, nothing in these Terms is intended to:
- Remove a customer's mandatory consumer rights
- Exclude a valid statutory right to compensation
- Exclude liability for fraud or fraudulent conduct
- Exclude liability for death, personal injury or material damage where liability cannot lawfully be excluded
- Remove obligations relating to defective or unsafe products
- Prevent a customer from exercising a legal remedy available under UAE law
No provision of these Terms should be interpreted as requiring a consumer to waive a right that cannot legally be waived.
30. CUSTOMER RESPONSIBILITY
Customers must use products reasonably and in accordance with any applicable product or care instructions.
weartheclouds is not responsible for damage resulting solely from:
- Misuse
- Abuse
- Improper cleaning or care
- Unauthorised alteration
- Failure to follow applicable care instructions
- Ordinary wear and tear
This section does not apply where the underlying problem results from a manufacturing defect or another matter for which we are legally responsible.
31. FRAUD AND ABUSE
We reserve the right to investigate reasonably suspected:
- Payment fraud
- Chargeback abuse
- Promotion abuse
- Return fraud
- Account misuse
- Identity misuse
- Unauthorised resale
- Other fraudulent activity
Where reasonably justified, we may:
- Decline or cancel an order
- Restrict an account
- Refuse a fraudulent return
- Preserve relevant records
- Refer suspected unlawful conduct to payment providers, professional advisers or competent authorities
Any such action will remain subject to applicable law and legitimate consumer rights.
32. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delay or failure caused by circumstances genuinely outside our reasonable control to the extent permitted by applicable law.
These circumstances may include:
- Natural disasters
- Extreme weather
- War or civil disturbance
- Government action
- Transportation disruption
- Widespread telecommunications failure
- Widespread internet or infrastructure disruption
- Labour disruption
- Public health emergencies
- Other comparable events beyond our reasonable control
We will take reasonable steps to minimise the impact where possible.
This section does not remove any refund or consumer right that applies despite such circumstances.
33. SUSPENSION AND TERMINATION
We may suspend or terminate access to an account or the Site where reasonably necessary because of:
- Serious violation of these Terms
- Fraud
- Security threats
- Unlawful activity
- Repeated abuse of our systems
- Unauthorised commercial activity
Termination of Site access does not remove rights or obligations relating to transactions that occurred before termination.
Consumer rights relating to previous purchases continue to apply.
34. CHANGES TO THESE TERMS

Changes to these Terms will apply from the date they become effective.

The remaining provisions will continue to apply to the extent permitted by law.
36. NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we have permanently waived our right to enforce it later.
Likewise, nothing in these Terms requires a customer to waive any statutory consumer right that cannot legally be waived.
37. ENTIRE AGREEMENT
These Terms, together with the policies expressly incorporated into them, form the agreement governing your use of the Site and purchases from weartheclouds, subject to applicable law.
Relevant policies may include our:
- Privacy Policy
- Return & Exchange Policy
- Other policies or promotional conditions expressly presented to you in connection with a particular transaction
If a mandatory requirement of applicable law conflicts with any provision of these Terms or another policy, the mandatory legal requirement will prevail.
38. GOVERNING LAW AND JURISDICTION
These Terms and transactions with weartheclouds are governed by the applicable laws of the United Arab Emirates and, where applicable, the laws and regulations in force in the Emirate of Dubai.
Subject to any mandatory consumer rights, statutory dispute-resolution procedures or jurisdictional requirements that apply, disputes arising out of or relating to these Terms, the Site or purchases from weartheclouds will be subject to the jurisdiction of the courts having competent jurisdiction in Dubai, United Arab Emirates.
Nothing in this section prevents either party from using a consumer complaint, mediation or other dispute-resolution mechanism available under applicable UAE law before commencing court proceedings.
